Terms of Service
Version 1.0, last updated 5 October 2026
These terms apply when you use this website, send us an enquiry, have a customer account or book services with Sound Wave Studios Pty Ltd (ABN 53 614 208 973). "We", "us" and "our" mean Sound Wave Studios. "You" means the person or business using the website or our services.
We provide audio production services, including recording, mixing, mastering, podcast production, voiceover and sound design for film and advertising. By using the website or booking with us, you agree to these terms. How we handle your personal information is set out separately in our Privacy Policy.
Using the website
You may use the website to learn about our services, send an enquiry and, if you are a customer, manage your bookings, invoices and messages. When using the website you must not:
- use it for anything unlawful or to harass, threaten or mislead anyone
- send spam or try to get around the spam check on the enquiry form
- try to access accounts, data or parts of the website you are not authorised to use
- upload or send viruses or other harmful code
- scrape, copy or collect information from the website in bulk
We try to keep the information on the website accurate and up to date, but service descriptions and examples are general information only. The details that apply to your project are the ones we agree with you in writing.
Enquiries and quotes
Sending an enquiry does not create a booking or commit either of us to anything. We will reply to agree the scope, dates and price of your project. A booking is confirmed only when we confirm it to you in writing or it appears in your customer dashboard.
Your quote or confirmed booking sets out the details of your project, such as the services, session dates, price, payment due dates, number of revisions and any deposit or cancellation terms. If anything in your quote or booking differs from these terms, the quote or booking applies.
Customer accounts
When we take you on as a customer, we email you an invitation to create an account. The invitation expires after 48 hours and we can send a new one if it lapses. You are responsible for:
- giving us accurate details and keeping them up to date
- keeping your password secure and not sharing your account
- everything done through your account
- telling us straight away if you think someone else has used your account
For security, you are signed out after 30 minutes of inactivity and password reset links expire after 30 minutes.
Bookings and sessions
Please arrive on time for studio sessions. If you are late, we may not be able to extend the session past its booked time. To change or cancel a booking, message us from your dashboard or email us as early as you can. We will try to move your booking to another time, subject to availability. Any cancellation or rescheduling fees are those set out in your quote or booking.
If we have to reschedule a session, for example because of illness or an equipment fault, we will tell you as soon as possible and offer another time. If no other time suits you, we will refund anything you have paid for that session.
You must look after our studio and equipment while you are there and you are responsible for any damage you or your guests cause, other than fair wear and tear.
Prices and payment
Prices are in Australian dollars. Your quote or invoice shows the price and whether GST applies.
We send invoices through your customer dashboard. You pay them on Stripe's secure checkout page and we email you a receipt once payment is confirmed. Your card details go to Stripe and never reach us, and Stripe's own terms apply to the payment.
Please pay each invoice by its due date. We send reminders for unpaid invoices. If an invoice stays unpaid after its due date, we may pause work on your project and hold back final deliverables until it is paid.
Material you give us
You may give us audio, video, scripts, artwork, samples or other material to use in your project. You confirm that you own that material or have permission to use it, including any music, samples or recorded voices or performances of other people.
You keep ownership of your material. You allow us to use, copy and edit it only as needed to deliver your project.
Ownership of the finished work
Once you have paid for a project in full, you own the copyright in the final deliverables we create specifically for you, such as your final mixes, masters, edits and sound design.
We keep ownership of anything we created before your project or use across many projects, such as our templates, presets, sound libraries, tools and know-how. Where any of these form part of your final deliverables, you may use them as part of that work.
We will only name you or use your work in our portfolio or marketing if you give us permission in writing.
Delivery and revisions
We deliver finished work through your customer dashboard or by another method we agree with you. Please review it and let us know about any changes you need within the time set out in your quote. The number of revision rounds included in the price is set out in your quote. We may charge for further revisions or changes in scope and will tell you the cost before doing the work.
We are not an archive service, so please keep your own copies of everything we deliver. We may not keep project files once a project is finished.
Your rights under the Australian Consumer Law
Nothing in these terms limits any rights you have under the Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us
- to a refund for the unused portion or to compensation for its reduced value
You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Limits on our liability
To the extent the law allows:
- where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited to supplying the services again or paying the cost of having them supplied again
- we are not liable for indirect or consequential loss, such as lost profits or lost opportunities
- we are not liable for loss caused by your material, by you breaching these terms or by events outside our reasonable control
We work to keep the website available and secure, but we cannot promise it will always be uninterrupted or error-free.
Third-party services
Parts of the website rely on other providers, such as Stripe for payments and Cloudflare for spam checks. Our Privacy Policy lists these providers and what they do. We are not responsible for websites or services run by others, including any website you reach through a link on ours.
Suspending or ending your account
You can ask us to close your account at any time by emailing us. We may suspend or close your account or stop work on a project if you seriously breach these terms or do not pay an invoice after we have reminded you. If we do, you still need to pay for work already done and we will refund anything you have paid for work we have not done.
Closing an account does not delete invoices and payment records we must keep by law. Our Privacy Policy explains what we keep and for how long.
Privacy
Our Privacy Policy explains how we collect, use, store and share your personal information and how you can access or correct it.
Changes to these terms
When we change these terms we update the date at the top. If a change affects a booking you have already made, the terms that applied when you booked continue to apply to that booking unless you agree otherwise. If a change affects your customer account, we will email you before it applies.
Governing law
These terms are governed by the laws of Victoria, Australia. You and we agree to the jurisdiction of the courts of Victoria.
Questions, complaints and contact
If you have a question or complaint about these terms or our services, please contact us first with enough detail for us to look into it. We will give you our answer within 30 days.
